Terms of Service

Welcome to Get Allocated ("we," "our," or "us"). By downloading, installing, or using the Get Allocated mobile application, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

1. Eligibility

You must be 21 years of age or older to use Get Allocated. By creating an account, you confirm that you meet this requirement. We collect your date of birth during onboarding to verify eligibility. Users found to be under 21 will have their accounts terminated.

2. Community Purpose

Get Allocated is a community platform for bourbon enthusiasts to share real-time sightings of allocated and hard-to-find bottles at NC ABC stores and licensed venues. The app is intended solely for informational and community purposes — helping enthusiasts know where bottles are available on shelves.

3. Prohibited Conduct

By using Get Allocated, you agree not to:

• Buy, sell, or trade alcohol through the app. Get Allocated is not a marketplace. Do not use sighting notes, messages, or any app feature to arrange the sale, trade, or transfer of alcohol. This includes language such as "FT" (for trade), "ISO" (in search of), or any price negotiation.
• Post false, misleading, or malicious sightings intended to deceive other users
• Harass, abuse, or threaten other users
• Use the app to facilitate any activity that violates North Carolina ABC laws or any applicable federal, state, or local law
• Attempt to reverse-engineer, scrape, or interfere with the app or its infrastructure
• Create multiple accounts or impersonate another person
• Post content that is obscene, defamatory, or otherwise objectionable

We reserve the right to remove content and terminate accounts that violate these terms without notice.

4. User-Generated Content

You are responsible for any sightings, notes, or other content you post. By posting content, you grant Get Allocated a non-exclusive, royalty-free license to display and distribute that content within the app. You represent that your content does not violate any third-party rights or applicable law.

5. Accuracy of Sightings

Sightings are submitted by community members and are not verified by Get Allocated. We make no guarantee as to the accuracy, completeness, or timeliness of any sighting. Bottle availability changes rapidly — always confirm availability before traveling to a store.

6. Location Data

The app uses your device's GPS location to detect nearby NC ABC stores when you log a sighting. Location data is processed on-device and is not stored on our servers. See our Privacy Policy for full details.

7. Alcohol Responsibility

Get Allocated is a tool for locating bottles, not for encouraging excessive consumption. We support responsible drinking. Nothing in this app should be construed as encouragement to purchase more alcohol than is legal or appropriate. Please drink responsibly.

8. Account Termination

You may delete your account at any time from within the app (Profile → scroll to the bottom → Delete Account) or at getallocated.app/delete-account. Deletion permanently removes your profile, sightings, watchlist, and all associated data from our servers. We may also suspend or terminate accounts that violate these Terms.

9. Get Allocated Pro (Subscriptions)

Get Allocated is free to use. We also offer Get Allocated Pro, an optional subscription that removes ads and unlocks additional features. The features included in Pro may change over time.

• Billing. Subscriptions are purchased and billed through the Apple App Store or Google Play and are subject to their terms. Payment is charged to your Apple ID or Google Play account when you confirm your purchase. We never see or store your payment card details.
• Auto-renewal. Subscriptions renew automatically at the end of each period (monthly or annually) unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription.
• Pricing. Subscription prices are based on the membership tier assigned to your account when you joined, and the price shown before purchase is the price you pay. We may change prices for new subscribers. If a price change affects an existing subscription, you will be notified in advance by Apple or Google as required, and you may cancel before it takes effect.
• Complimentary access. Some members receive Pro at no cost or for a limited free period based on their membership tier. When a complimentary period ends, Pro features simply turn off — you are never charged unless you choose to subscribe.
• Refunds. Purchases are processed by Apple or Google, and refund requests are handled by them under their policies. We cannot issue refunds directly.
• Termination. If your account is suspended or terminated for violating these Terms, your access to Pro ends and we do not provide refunds for any remaining subscription period. Please cancel through Apple or Google to stop future charges.

10. Advertising

The free version of Get Allocated may display ads served by third-party advertising partners. Ads are never shown to Pro members. See our Privacy Policy for how advertising data is handled and the choices available to you.

11. Disclaimer of Warranties

Get Allocated is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the app is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, ShadowShu Apps and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Get Allocated, including but not limited to loss of data, lost profits, or personal injury.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by updating the date at the top of this page. Continued use of the app after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
